US Judge Mandates Release of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in immigration detention.
In her order, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The court challenge center on disputed claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.
Conditions of Freedom
The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This ruling marks a notable development in a complex legal battle featuring allegations of mistaken imprisonment and disputed gang associations.
